1. Agreement to Terms
By accessing or using Waddle ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service. Waddle is operated by Waddle ("we," "us," or "our").
2. Description of Service
Waddle is an AI-powered video generation platform that allows users to create videos from images using text descriptions. The Service includes:
- Uploading and processing images
- Generating videos using AI technology
- Downloading and sharing created content
- Account management and subscription services
3. User Accounts
To use certain features of the Service, you must create an account using Google or Apple authentication. You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
You must be at least 13 years old to use this Service. If you are under 18, you must have parental or guardian consent.
4. Subscription Plans and Payments
We offer the following subscription tiers:
- Free: Limited features with watermarked output
- Slide ($2.99/month): No watermark, ad-free experience
- Glide ($10.99/month): 3 concurrent generations, faster processing
- Dive ($24.99/month): 10 concurrent generations, fastest processing
Payments are processed securely through Stripe. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
Refund Policy
Free Trial Before Purchase: Our free tier provides full access to the core video generation functionality, allowing you to evaluate the Service before subscribing to a paid plan. We encourage all users to test the Service thoroughly using the free tier before committing to a paid subscription.
Immediate Access & Waiver of Withdrawal Right: By subscribing to a paid plan, you expressly consent to immediate access to the Service and acknowledge that you lose your right of withdrawal once you begin using paid features. This is in accordance with Article 16(m) of the EU Consumer Rights Directive, which provides that the right of withdrawal does not apply to digital content when performance has begun with your prior express consent and acknowledgment that you lose your cancellation right.
No Refunds: Due to the immediate delivery of digital services and the computational resources consumed during video generation, all subscription payments are final and non-refundable. This applies to:
- Monthly subscription fees
- Unused portions of subscription periods
- Videos that do not meet subjective expectations
Exceptions: We may provide refunds at our sole discretion in cases of:
- Duplicate charges or billing errors
- Service completely unavailable for extended periods (more than 72 hours)
- Technical failures preventing any video generation during your subscription period
For billing issues, contact us at support@waddle.run within 14 days of the charge.
5. User Content and Ownership
Your Content: You retain all ownership rights to images you upload and videos you create using the Service. By uploading content, you grant us a limited license to process your content solely for the purpose of providing the Service.
Acceptable Use: You agree not to upload or create content that:
- Infringes on intellectual property rights of others
- Contains illegal, harmful, or obscene material
- Depicts minors in inappropriate situations
- Constitutes harassment, defamation, or fraud
- Violates any applicable laws or regulations
- Creates deepfakes or misleading content intended to deceive
We reserve the right to remove content and suspend accounts that violate these terms.
6. Prohibited Content and Synthetic Media Policy
You expressly agree NOT to use the Service to:
a) Create realistic depictions of real, identifiable persons without their explicit written consent, including but not limited to:
- Public figures, politicians, celebrities, or private individuals
- Content that could reasonably be mistaken for authentic footage
b) Generate any sexually explicit or intimate content depicting real persons, regardless of consent claimed
c) Create content intended to:
- Interfere with or influence elections or political processes
- Defraud, harass, threaten, or intimidate any person
- Spread disinformation or impersonate others
- Defame or damage the reputation of any person
d) Remove, obscure, or alter any watermarks, metadata, or provenance information from generated content
e) Represent AI-generated content as authentic or real footage
You acknowledge that you are solely responsible for ensuring your use complies with all applicable laws regarding synthetic media, including but not limited to the EU AI Act, the US TAKE IT DOWN Act, and relevant state laws on deepfakes.
7. User Indemnification
You agree to indemnify, defend, and hold harmless Waddle, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Content you create, upload, or distribute using the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
- Any claim that content you created constitutes illegal synthetic media or deepfake content under applicable law
This indemnification obligation survives termination of your account.
8. Content Reporting and Takedown
If you believe content created using our Service violates your rights or applicable law, submit a report to support@waddle.run including:
- Your contact information
- Identification of the content at issue
- Basis for your claim
- Statement of good faith belief
We will investigate and respond within 30 business days. We reserve the right to remove content and terminate accounts at our sole discretion.
We cooperate with law enforcement agencies investigating illegal use of synthetic media and will preserve and disclose user information when legally required.
9. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Waddle and is protected by copyright, trademark, and other intellectual property laws. Our trademarks may not be used without prior written consent.
10. AI-Generated Content Disclaimer
Videos generated by our AI are created algorithmically and may not always produce expected results. We do not guarantee specific outcomes. You are solely responsible for reviewing generated content before sharing or publishing it. AI-generated content should not be used to deceive others or for malicious purposes.
11. Limitation of Liability
To the maximum extent permitted by law, Waddle shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.
13. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.
14. Analytics and Monitoring
We use product analytics (PostHog, hosted in the EU) to monitor the Service for errors, understand how features are used, and improve the user experience. PostHog does not store cookies or any data on your device. If you are signed in, we associate analytics events with your account using a pseudonymous identifier to track user journeys across pages. With your consent, we may additionally record session replays for troubleshooting. Full details, including how to opt out, are described in our Privacy Policy (Section 7).
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
16. Governing Law and Jurisdiction
These Terms shall be governed by the laws of Sweden. Any disputes shall be resolved in the courts of Stockholm, Sweden.
For users in the European Union, nothing in these Terms affects your statutory rights under applicable consumer protection laws.
